THIS AGREEMENT GOVERNS THE TERMS ON WHICH YOU MAY USE PlanterPlan AND ITS COMPONENTS. IT IS A LEGAL AGREEMENT.
Software License Agreement Terms
This agreement is a legal agreement between you (either as an individual or a single entity, "you") and Passion for Planting (P4P) relating to your rights to use PlanterPlan (referred to as ‘this software' in the remainder of this document), its components, and its content. By using this software, you agree to be bound by the terms of this agreement.
P4P grants you the right to use this software for one church planting project. If you represent an organization, network, or group and wish to use this software for more than one project you must contact P4P.
The user is bound by the following usage restrictions:
The user may not modify, reverse engineer, duplicate content, lease, or rent the software. This includes extracting content from PlanterPlan and sharing it with other individuals or groups outside of your direct project team.
User accepts delivery of this software when they have successfully logged in. It is the user's responsibility to contact P4P immediately if there is any question about their access to the system. No refunds are available.
As an on-line application new features and enhancements are always being considered and when appropriate, added to the system. P4P makes no specific guarantees regarding implementation of future features or content.
No customization of this application or its content is included in this agreement. If you or your organization would like to discuss customizing the software or its content for your church plant project or organization, please contact P4P at 703-817-0601.
P4P retains all ownership of this software and content which is included except where content was created by others in which case they retain all ownership of the content they provided. Content may not be reproduced or distributed in any manner outside of your direct project team without express written consent of P4P.
This agreement does not operate to transfer any ownership or intellectual property rights in this software to you other than the limited license to use this software. By accepting this agreement you agree not to attempt to reverse engineer, decompile, translate, adapt, or disassemble any part of this software or to incorporate this software (or any part of it) in any other product or service.
P4P performs routine backups of the databases. Should an extended outage of our servers occur, you will be provided an alternate domain to access your database. It is the user's responsibility to contact P4P if they are unable to access the system.
THIS SECTION LIMITS YOUR RIGHT TO SEEK COMPENSATION FOR DAMAGE RESULTING FROM THE USE OF THIS SOFTWARE. BY ACCEPTING THIS AGREEMENT YOU CONFIRM THAT YOU AGREE THAT THE LIMITATIONS IN THIS SECTION SHOULD FOR ALL PURPOSES BE DEEMED TO BE REASONABLE HAVING REGARD TO THE PRICE PAID FOR THIS SOFTWARE AND THE ADVICE GIVEN BELOW.
P4P has made reasonable efforts to ensure that this software is stable and integrates with standard browser and internet connections, however because of the variety of browsers and plug-ins, no warranty of fitness for a particular purpose is offered out and, to the extent permitted by law, all implied warranties as to fitness are excluded. P4P has made every effort to ensure that this software and our servers are virus free, however due to the nature of web-based applications; we recommend that you deploy up-to-date virus protection software. The user assumes the entire risk using this software (or any part of it). To the extent permitted by law, the user's exclusive remedy is limited to refund of purchase price. Users of this software agree to use the software on an "as is" basis, with support from P4P not to exceed the support outlined in this agreement.
Additionally, P4P makes no specific guarantee of and is not liable for the results of implementing any content included in the system. Users are cautioned not to rely on the content of the system as legal advice as the content is no substitution for a consultation with an attorney in your state. Based on jurisdiction and time, the law varies and changes.
P4P assumes no liability to cover damages incurred by the user in any way.
The agreement entitles your project to three (3) customer support calls during the duration of your project. These calls may be on the operation of this software or on the content of the software.
